Terms and Conditions – Karukhaya by Wagner

1. Scope

These Terms and Conditions ("Terms") apply to all orders placed via the online shop of Karukhaya by Wagner (hereinafter "Karukhaya", "we", "us") at www.karukhaya.ch. By completing an order, you accept these Terms. Deviating conditions of the purchasing party shall only apply if we have expressly agreed to them in writing.

2. Contracting Party

3. Formation of Contract

The presentation of products in our online shop does not constitute a legally binding offer, but a non-binding invitation for you to place an order. By submitting your order through the checkout process, you make a binding offer to purchase the selected items.

The purchase contract is formed once we accept your order by way of an order confirmation sent by email, or at the latest upon shipment of the goods. Before completing your order, the total price, including any shipping costs, will be clearly displayed to you.

We reserve the right to decline orders, in particular in the event of evident errors in the pricing or product presentation, payment issues, or reasonable suspicion of misuse.

4. Prices and Payment Terms

All stated prices are in Swiss francs (CHF). Karukhaya by Wagner is currently not subject to VAT registration; the prices shown therefore do not include Swiss value-added tax.

Payment may be made using the payment methods offered at checkout (including TWINT and credit card). Payment is due at the time the contract is formed.

5. Delivery and Shipping

We deliver within Switzerland. Shipping costs are displayed before the order is completed; orders with a value of CHF 120 or more are shipped free of charge.

Delivery times are stated on the respective product page or at checkout and begin upon receipt of payment or order confirmation. In the event of delays caused by force majeure, customs, or transport issues, we will inform you as soon as possible.

The risk of accidental loss or deterioration of the goods passes to the purchasing party, or to the recipient designated by them, upon handover.

6. Retention of Title

The delivered goods remain the property of Karukhaya by Wagner until the purchase price has been paid in full.

7. Returns and Exchanges

Under applicable Swiss law, there is no statutory right of withdrawal or return for online purchases. Karukhaya by Wagner nevertheless voluntarily grants you the following return option:

  • You may return unused, originally packaged items within 14 days of receipt.
  • The cost of return shipping is borne by the purchasing party.
  • The refund will be issued to the payment method originally used, following receipt and inspection of the returned goods.
  • Items showing visible signs of use beyond mere trying-on are excluded from return.

This provision is a voluntary goodwill arrangement and does not constitute a statutory entitlement.

8. Warranty

The statutory warranty provisions of the Swiss Code of Obligations (Art. 197 et seq. CO) apply.

You are obliged to inspect the delivered goods upon receipt and to report any defects in writing without delay, and no later than within 3 business days of discovery (duty to notify defects pursuant to Art. 201 CO). In the event of a late notification of defects, the goods shall be deemed approved, and warranty claims may be forfeited.

In the case of a justified, timely notification of defects, you are entitled to repair, replacement, a reduction in the purchase price, or rescission of the contract, in accordance with the statutory provisions. The limitation period for warranty claims is two years from delivery of the goods (Art. 210 CO).

9. Natural Materials and Product Characteristics

Our products are made from genuine lambskin and leather. As natural materials, the fur, colour, and texture may vary slightly from piece to piece; such natural variations do not constitute a defect. Care instructions for your product can be found on the enclosed care card as well as on our website.

10. Liability

For damages resulting from injury to life or limb, as well as for damages arising from a defective product within the meaning of the Product Liability Act (PrHG), we are liable to the extent provided by law; this liability is not and will not be limited or excluded by these Terms.

Beyond that, we are liable only for damages resulting from an intentional or grossly negligent breach of duty on our part. Liability for slight negligence in connection with indirect damages, consequential damages, or loss of profit is excluded, to the extent permitted by law.

11. Data Protection

The processing of your personal data in connection with order processing is governed by our separate Privacy Policy, available at www.karukhaya.ch.

12. Intellectual Property

All content in our online shop, in particular texts, images, logos, and the "Karukhaya" trademark, is protected under copyright and/or trademark law. Use without our prior written consent is not permitted.

13. Changes to These Terms

We reserve the right to amend these Terms at any time. The version published on the website at the time the order is placed shall be decisive.

14. Governing Law and Jurisdiction

These Terms, as well as all contractual relationships between Karukhaya by Wagner and the purchasing party, are governed by substantive Swiss law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction for disputes with merchants, as well as with customers not domiciled in Switzerland, is Winterthur. For consumers domiciled in Switzerland, the mandatory statutory provisions on jurisdiction in their favour (in particular Art. 32 et seq. of the Swiss Civil Procedure Code) additionally apply and are not limited by this provision.

15. Final Provisions

Should any provision of these Terms be or become invalid, the validity of the remaining provisions shall not be affected.
